MARGINAL ENTRIES

Any change in marital status or family situation must be reported so that it can be incorporated into civil status documents.

Mention of marriage

Notices of marriage to be entered on the civil-status documents of Algerian nationals born in Algeria and married in France are sent directly by the French town halls which celebrated the marriage to the Algerian communes covering the birthplaces of the persons concerned. The Algerian civil registrar acknowledges receipt of the notice, after transferring the entry to the margin of the record in the register.

However, some French town halls send these notices via the consulate's registry office, which in turn forwards them to the town halls concerned.

People whose birth certificates have not been updated are invited to contact the Mairies of the place where the marriage took place, to request that the notice of marriage be sent to the Mairie of the place of birth.

People who have celebrated their marriage with our consular district and whose civil status in Algeria has not been updated are invited to check whether the notice of marriage has been sent to the Mairie of the place of birth in Algeria.

People born and married abroad whose birth certificates were transcribed before the marriage must request transcription of the marriage certificate from the Algerian consulate with territorial jurisdiction, in order to update their civil status with the consulate that transcribed the birth.

People born abroad and married in Algeria whose birth certificate has already been transcribed must update their civil status by presenting a marriage certificate or a copy of the family record book issued by the Algerian town hall where the marriage took place.

Mention of divorce/Exequatur

To be enforceable by consular services, any divorce decree issued by a foreign court must be certified by the competent court in Algeria.

To obtain the exequatur of a judgment in a civil matter, persons born in Algeria or abroad and divorced before a foreign court must apply to the personal status judge of the court corresponding to their place of birth, if they were born in Algeria, or to the Sidi M'Hamed court in Algiers, if they were born abroad.

Once this procedure has been completed, the court will forward the divorce notice, as appropriate, to the town hall of the place of birth or to the diplomatic or consular representation, which will update the civil status of the persons concerned.

The following documents, accompanied by an Arabic translation, must be attached to a handwritten request:

the original and a photocopy of the final divorce decree.
The original document notifying the other party of the divorce decree (usually supplied by the bailiff responsible for serving the decree).
An attestation or certificate of non-opposition, non-appeal and non-appeal in cassation, to be requested from the clerk of the foreign court that issued the judgment.
If the marriage was celebrated abroad, the marriage certificate must be transcribed by the relevant diplomatic or consular representation.
A copy of an Algerian identity document.
